By accessing or using Factor Avenue, you agree to be legally bound by these Terms and Conditions. If you do not agree, you must not use the Platform. Your continued use of the Platform constitutes acceptance of these terms.
2) Use of the Platform
Factor Avenue grants you a limited, non-exclusive, non-transferable license to use the Platform strictly for managing factoring, invoice financing, credit control, funding, collections, and related operations.
You agree not to:
- Attempt unauthorized access to restricted systems or data
- Reverse engineer, copy, resell, or replicate the software
- Use the Platform for unlawful, fraudulent, or harmful activities
- Interfere with system integrity, security, or performance
Violation may result in immediate suspension or termination of access.
3) Account Registration and Security
To access certain features, users must create an account and provide accurate information. You are responsible for maintaining the confidentiality of login credentials and for all actions taken under your account.
If you suspect unauthorized access, you must notify us immediately.
4) Subscription, Fees, and Payments
Factor Avenue operates on a subscription-based pricing model.
- Fees are payable in advance as per your agreed subscription plan
- Payments are generally non-refundable unless stated otherwise in writing
- Failure to pay fees may result in suspension of access until dues are cleared
Specific commercial terms will be defined in your service agreement or order form.
5) Intellectual Property Rights
All intellectual property rights in the Platform, including software, design, workflows, logos, trademarks, documentation, and content, are owned by Pysar Infotech Private Limited.
You may not copy, distribute, modify, or create derivative works without written permission.
6) Data Privacy and Security
Your use of the Platform is also governed by our Privacy Policy. By using Factor Avenue, you consent to data collection and processing necessary for providing services, improving the Platform, and meeting legal obligations.
We implement encryption, role-based access controls, audit logs, and SOC-2-ready infrastructure to protect sensitive data.
7) Permitted Use of Data
You retain ownership of your business data. Factor Avenue processes this data solely to deliver the service. We do not sell or share your data with third parties except where required for integrations, legal compliance, or with your consent.
8) Service Availability
While we strive for 99.9% uptime, Factor Avenue is provided on an “as-available” basis. Temporary downtime may occur due to maintenance, updates, or technical issues.
We are not liable for losses caused by temporary unavailability.
9) Termination of Service
We reserve the right to suspend or terminate accounts if:
- These Terms are violated
- Fraudulent or malicious activity is detected
- Required payments are not made
Upon termination, access to the Platform will cease.
10) Limitation of Liability
Factor Avenue is provided “as is” without warranties of any kind. Pysar Infotech Private Limited is not liable for any indirect, incidental, or consequential damages including loss of data, revenue, or business interruption.
11) Indemnification
You agree to indemnify and hold harmless Pysar Infotech Private Limited from any claims, damages, or legal expenses arising from misuse of the Platform or violation of these Terms.
12) Changes to Terms
We may update these Terms from time to time. Updated versions will be posted on the website. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
13) Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from these Terms shall fall under the jurisdiction of courts located in Lucknow, Uttar Pradesh, India.
